Aunque ya hemos hablado de este tema en nuestro capítulo 8 y 18 del podcast, así como hicimos post en nuestro blog. Nunca cesan las novedades sobre los gastos dimanantes de los préstamos hipotecarios. Según la última sentencia de nuestro Tribunal Supremo de fecha 20 de enero de 2020, la acción de reclamación del importe de los gastos prescribía. Por lo que muchos consumidores los cuales siempre han tenido la ocasión de reclamar sus gastos, ahora se veían abocados a correr o ya se les había pasado el plazo. Para las relaciones jurídicas nacidas después del 7 de octubre de 2015: se les aplica el nuevo plazo de 5 años, lo que ocurre es que la declaración del estado de alarma por la pandemia del COVID-19 se suspendieron los plazos de prescripción y caducidad hasta que fueron alzados el 4 de junio de 2020. Esto ha provocado que el plazo de prescripción que finalizaba el 7 de octubre de 2020 se ampliaba hasta el 28 de diciembre de 2020. Todos los letrados que llevamos a los consumidores sabíamos que era una solución injusta la cual carece de sentido, pues la restitución de los gastos es un efecto inherente a la nulidad, y la nulidad es imprescriptible. Ahora parece que de nuevo tenemos a nuestro TJUE de nuestro lado, pero tenemos que esperar que dice de nuevo nuestro TS y las audiencias provinciales.
