Changes to the Ontario Heritage Act Unexpectedly Shift Responsibilities (and Risk)

In this webinar, we will discuss some unexpected changes to the Ontario Heritage Act over the past five years (by way of Bill-23, -108, and -200 amongst others), including a streamlined approvals system for development, free of red tape, alongside the potential consequences to the environment, heritage buildings, and First Nations sites in the province. With these changes comes a shift in responsibilities (and risks) for those in the construction industry, including, for example, if and when an archaeological assessment needs to take place. In this Webinar, lawyers from Kennaley Construction Law welcome back special guest Lorraine Land, partner with OKT (Olthuis Kleer Townshend LLP) and an adjunct professor at Osgoode Hall law school, to discuss this regulatory landscape as it continues to shift. This Webinar is part of a series in which we offer free 1 hour seminars every Tuesday morning, from 8:30 - 9:30 am, on a variety of timely issues and topics. Our goal is to provide focused and practical information, and to conclude each session on the hour with additional time then set aside for questions and discussion for those that want to stay behind. We hope to see you there!

To Lien or Not to Lien: What Qualifies as Lienable Work

In Ontario, services and materials are considered lienable if same are supplied to an "improvement”. This might include any alteration, addition, capital repair, demolition, or construction on the land or premises. This broad scope encompasses on-site and off-site services, building materials, and equipment rentals, provided they are necessary for the project's completion and benefiting all construction parties. However, sometimes works performed by a contractor, subcontractor or supplier may not qualify under the Construction Act, or adjacent case law, as being “lienable” work. In this episode, lawyers from Kennaley Construction Law will address this issue and explore the nuances.
