------------------------------------------------------------------------ Are western ranchers making an unconstitutional stand? ----------------------------------------------------------------------------------------------------- The Atlantic published an article in April 2014 entitled, "The Irony of Cliven Bundy's Unconstitutional Stand" (linked in our resources below). The article proposes that Bundy's fight to resist the Bureau of Land Management was unconstitutional from his very own state's perspective, citing the Nevada Constitution's Article 1, Section 2, which declares "the Paramount Allegiance of every citizen is due to the Federal Government" This "Paramount Allegiance" clause was in fact adopted by Nevada when the state gained statehood around 1863. Other states have adopted this clause as well, and it has been maintained by Nevada to present day. ----------------------------------------------------------------------------------------------------- Of course, America's Remedy espouses that Reconstruction of 1867/68 and the resulting Fourteenth Amendment nationalized American citizenship and was indeed the lynchpin that reversed the relationship between state and federal. ----------------------------------------------------------------------------------------------------- This all begs more than a few questions, and we believe it demands more research as well. ----------------------------------------------------------------------------------------------------- Firstly, since Nevada declared "Paramount Allegiance" to the Federal Government in 1863, does this mean Nevada truly became nationalized and loyal to federal/national power prior to the Reconstruction Acts of the 39th congress in 1867? Secondly, is this "Paramount Allegiance" clause a nullity outside of original intent? Or are the people that compose the state of Nevada bound with no legal recourse, as a result of their state's initial declaration of allegiance to Federal/National control? Is there a difference between legal recourse and violent revolution?
