Will and Inheritance Disputes
Welcome to Berry & Lamberts Solicitors’ podcast series, ‘Planning for your Future’.In this episode, Managing Partner, Paul Reader, talks in detail about Will and Inheritance Disputes and the importance of the Inheritance Act (provision for family and dependants) 1975.There has been a significant rise in the number of Will and Inheritance disputes over recent years, possibly linked to the significant change in family structures with remarriages, step families and co-habitation. Adding to this, is an increase in ‘DIY’ Wills where mistakes may have been made, rending them either invalid or open to challenge. There may also be concerns as to the validity of Wills, either due to lack of capacity, duress or undue influence and the lack of provision for family and dependants. Our 'Planning for your Future' series discusses, in everyday language, how planning can help you navigate your way through the ups and downs of life and how getting your affairs in place now can assist your loved ones’ future responsibilities. Will Planning - Marriages past & present and providing for children from previous relationships
Welcome to Berry & Lamberts Solicitors’ podcast series, ‘Planning for your Future’.In this episode, Partner, Emma Houghton, talks in detail about Wills in relation to divorce and subsequent marriages and how to ringfence estates or assets for children from previous relationships.Your Will allows you to dictate what happens to your estate and any children, for whom you have parental responsibility, when you die. It enables you to make provision for those that you wish to benefit and preclude those that you may feel are not entitled to benefit for personal reasons.Divorce doesn't revoke a Will but for inheritance purposes your ex-spouse will no longer be able to benefit from it unless you have stated they should. However, if you re-marry and do not prepare a new Will, your children from any previous relationships may not benefit from your estate as you would wish. Our 'Planning for your Future' series discusses, in everyday language, how planning can help you navigate your way through the ups and downs of life and how getting your affairs in place now can assist your loved ones’ future responsibilities. If someone you know, love or care for has become incapable of managing their property and financial affairs, and they have not made either a Lasting or Enduring Power of Attorney, an application would need to be made to the Court of Protection for the appointment of a Deputy to manage those affairs. Inheritance Tax and Trusts
Welcome to Berry & Lamberts Solicitors’ podcast series, ‘Planning for your Future’.In this episode, Partner & Head of Private Client, David Lea, talks in detail about Inheritance Tax and Trusts. Inheritance Tax is applied to the value of all your assets at the date of your death. The rules around Inheritance Tax are complex and consequently can be difficult to navigate and understand. Lifetime Trusts can be used as a vehicle to reduce your inheritance tax liability when you die, protect and preserve your assets to ensure that they are directed to those you wish to benefit, on terms that you are able to dictate. Our team will take the time to understand you and your family circumstances. We will consider your wishes and circumstances before devising a plan for you to execute during your lifetime, with the aim of reducing the amount of inheritance tax that will become payable on death. Our 'Planning for your Future' series discusses, in everyday language, how planning can help you navigate your way through the ups and downs of life and how getting your affairs in place now can assist your loved ones’ future responsibilities. Wills, Codicils and Inheritance Tax Liabilities
Welcome to Berry & Lamberts Solicitors’ podcast series, ‘Planning for your Future’In this episode, experienced Private Client Solicitor, Lisa Maley, talks in detail about planning and writing your Will, Codicils and their function and any Inheritance Tax liabilities. Your Will allows you to dictate what happens to your estate and any children, for whom you have parental control, when you die. It enables you to make provision for those that you wish to benefit and preclude those that you may feel are not entitled to benefit for personal reasons. Families have become more complicated and diverse and as a consequence the act of Will drafting has become more of a minefield than ever. When drafting a Will it is important to consider a vast array of factors, including the potential risks or a claim against the estate by aggrieved parties and any adverse tax consequences that may arise as a result of your wishes. The task appears, on the face of it, a simple one but the impact of the Will can be anything but simple and straightforward. This is often realised by the people that you leave behind, when it is too late! Our 'Planning for your Future' series discusses, in everyday language, how planning can help you navigate your way through the ups and downs of life and how getting your affairs in place now can assist your loved ones’ future responsibilities.
