This podcast is about everything wealth: from building it to saving it to investing it and ultimately to passing it on through an estate plan. My name is Pete Williams. I have been in the estate and investment business for over 40 years. I would like to share my experiences, provide my knowledge and guide you in the journey from wealth creation through wealth transfer.

    HEMS: How to "skirt" structured payouts

    Often a trust leaves inheritance to beneficiaries in a structured, or delayed, payout instead of an all-at-once payout on the death of the Settlor. But, there is often language in the trust allowing the Trustee to make exceptions in the case of emergencies. This is often found in the "HEMS" language which are payouts for Health, Education, Maintenance and Support.

    Revocable Living Trusts Pt3

    In this episode of Revocable Living Trusts we get into some of the mechanics of trust administration post-death. The named successor trustee steps into the shoes of the decedent Settlor and now manages the trust property. They have a fiduciary responsibility to the beneficiaries of the trust to act in good faith and with proper capability. The trustee must perform valuations of property, accountings to the beneficiaries, assure that taxes are paid - both pre- and post- death.

    Continuation of a discussion of RLTs. In this episode we look at some of the terms and tax ramifications of the trust. While the trust is under the control of the Settlor/Creator while they are alive and well, it is important for a beneficiary to know why certain terms are included which might affect their ultimate inheritance.
