This morning we analyze the recent Alabama court ruling and legislation that led to the major providers of fertility treatments there closing their doors. We discuss how I predicted this when Roe v. Wade was overturned, that women who want a baby and need fertility treatment, may not be able to do so. We trace the faulty legal reasoning and bad policy that, sadly, could spread in the US (and perhaps elsewhere - who knows?). In commemoration of Yesh Tikva Infertility Awareness Weekend, we warn of the need to advocate for and support fertility treatment to be legal and accessible for everyone who wants/needs it. Michael Whitman is the senior rabbi of ADATH Congregation in Hampstead, Quebec, and an adjunct professor at McGill University Faculty of Law. ADATH is a modern orthodox synagogue community in suburban Montreal, providing Judaism for the next generation.
