He was charged as an adult for the murder of his classmate Tristyn Bailey, whom he killed brutally in the woods in Florida when he was only 14 years old. During his sentencing, Circuit Judge R. Lee Smith considered several factors, including Fucci's young age, the level of premeditation, and the fact that he acted alone without being coerced by anyone.
