A Celebration of Free Speech: Discussing Oral Arguments in “303 Creative v. Elenis”

Should the government be able to tell Americans what they can and cannot say? Or should artists be forced to express messages they don’t believe? What happens when public accommodation laws and free speech collide? These questions are at the heart of one of the Supreme Court’s biggest cases of the term, 303 Creative v. Elenis. In that case, graphic artist and website designer Lorie Smith has asked the Court to decide whether the state of Colorado can force her to create custom websites that violate her beliefs about marriage. At the heart of the controversy is Colorado’s Anti-Discrimination Act—the same law that the state used to target Christian cake artist Jack Philips of Masterpiece Cakeshop. Like Jack, Lorie simply wants the freedom to create and promote messages she believes.
