Patent Prosecution Examines recent trends in U.S. and worldwide patent filings and issuance, USPTO’s pilot programs for faster and improved examination of patents, USPTO’s practice under the America Invents Act (“AIA”) such as first-inventor-to-file and preissuance submission, the Global Patent Prosecution Highway Pilot Program, and recent Supreme Court decisions on patent eligibility under 35 U.S.C. § 101 and indefiniteness. II. Post-grant Proceedings Looks at recent trends at the PTAB, the PTAB process, and court and board decisions affecting the PTAB process, including topics such as stays, eligible patents and scope of review, eligible petitioners, multiple proceedings, time bars, common rejections of petitions, PTAB discovery, claim construction and amendments, settlement, appeal, and estoppel. III. District Court Litigation Summarizes recent trends in patent litigation, federal and state legislation focused on curbing abusive patent litigation, significant court decisions impacting patent litigation, standards-essential and FRAND-committed patents, and local practice updates such as the Eastern District of Texas “Track B” fast-track program. IV. ITC Litigation Examines recent trends in ITC litigation, initiatives at the ITC on case management and discovery, recent decisions on induced infringement of method claims, importation based on electronic transmission of digital data and licensing-based domestic industry, the Presidential veto of a commission decision in an investigation involving standards-essential patents, and trade secret cases at the ITC.
