De Hoge Raad bepaalde dat de klachtplicht van toepassing op loonvorderingen.De eerste zaak gaat over medewerkers van een café die pas na jaren overuren uitbetaald willen krijgen. De werkgever verweert zich met succes door te stellen dat er eerder geklaagd had moeten worden.In de tweede zaak lukte dat niet. Een paaldanser die via Tempo Team in een club werkte, kreeg niet al haar uren uitbetaald.
