Ako sa brániť proti nečinnosti stavebného úradu? #62

Dnes sa zameriame na nepríjemnú, ale bohužiaľ častú situáciu: nečinnosť stavebného úradu. Nečinnosť nastáva, keď úrad nekoná alebo nevydá rozhodnutie v zákonnej lehote. To je vážny problém, ktorý môže poškodiť práva občanov. Činnosť stavebných úradov sa riadi primárne Stavebným zákonom (nový zákon č. 25/2025 Z. z.) a subsidiárne Správnym poriadkom. Úrad musí vybaviť vec včas a bez zbytočných prieťahov. V jednoduchých veciach musí rozhodnúť bezodkladne, inak najneskôr do 30 dní od začatia konania, prípadne do 60 dní v zvlášť zložitých prípadoch. Dôležité je vedieť, že nečinnosťou sa rozumie aj také konanie, ktoré fakticky vedie k prieťahom, napríklad opakované a neoprávnené vyžadovanie podkladov. Nový Stavebný zákon od roku 2025 prináša dôležitý protiprieťahový mechanizmus: fikciu súhlasu. Ak úrad v stanovenej lehote (napríklad 30 dní pri jednoduchých stavbách) nereaguje na žiadosť o stavebný zámer, považuje sa to zo zákona za súhlas s realizáciou zámeru. Toto posilňuje pozíciu občana, no podmienkou je, že žiadosť musí byť úplná. Ak úrad mlčí, občan by mal postupovať hierarchicky. Prvým krokom je neformálna, ale dôrazná písomná urgencia. Ak táto výzva nepomôže, nasledujú formálne administratívne kroky. Máte dve hlavné cesty, ktoré musíte vyčerpať pred súdom: Sťažnosť na nečinnosť podľa zákona o sťažnostiach. Túto sťažnosť musí prešetriť nadriadený orgán do 30 pracovných dní. Ak je sťažnosť dôvodná, úrad musí okamžite začať konať.Podnet na prokuratúru. Prokuratúra preskúmava dodržiavanie zákonov.
