１９５２年１月２１日午後７時４２分、札幌市のススキノに近くの路上で、札幌市警察本部警備課課長の白鳥一雄警部が背後から共産党員に拳銃で銃撃され◯亡。１０月になり、日本共産党札幌軍事委員会委員長だった村上国治が事件の主犯格として逮捕された。村上は懲役20年の刑が確定。しかし、証拠となった弾丸について弁護側の検証により、捏造の疑いが持たれ、再審請求が行われた。結果としては再審請求は退けられたが、その最高裁決定の中で、再審への扉を開いたと言われる「白鳥決定」が出された。
