Stein, he assesses a 70% chance of victory for Coinbase in its motion to dismiss all claims made by the U.S. Securities and Exchange Commission (SEC). This evaluation follows the oral arguments presented by Coinbase on Wednesday. He highlighted how Judge Katherine Polk Failla wanted the SEC to provide a definition of “investment contract” that wouldn’t ultimately encompass innocuous collectable items such as Beanie Babies. The recent classification of LUNA and MIR as securities by a U.S. judge and an ongoing class action lawsuit in Singapore prompted this strategic move. Documents filed on January 21st indicate the voluntary petition for bankruptcy by Terraform Labs Pte.
