If the Buyer Backs Out With a Contingency: Buyers can walk away without penalty and get their earnest money refunded if protected by contingencies like inspection, financing, or appraisal. Without a Contingency: Buyers may lose their deposit (1-3% of the purchase price) or face legal action from the seller. If the Seller Backs Out Without a Valid Reason: Buyers can sue for breach of contract, seek damages, or force the sale through legal action.
