大家好，我是张庚园律师。大家有没有想过这样一个问题，就是用申请破产的方式来要债，这个可不可行呢？也就是说，能不能以破产相威胁要求公司偿还债务呢？在实践当中，可能会出现这样的情况，比如说A公司资不抵债了，无法偿还债务，其中的一个债权人B公司就向法院申请A公司破产。但真正的意图呢，是想迫使A公司能尽快地向B公司还债，而A公司也确实不想被破产，所以说呢，就把自己仅有的一点儿资产全都偿还给了B公司。B公司也就趁着法院还没有受理破产申请的时候呢，撤回了对A公司的破产申请……
