When a Buyer and Seller enter into the Florida As-Is Contract many times they have a different view of that As-Is means.  Buyer’s often believe they can ask for credits and/or repairs during the inspection period.  Seller’s often believe they are selling the house As-Is and they do not have to make any repairs.   Often when a Seller negotiates they will agree to a price but want to let the Buyer know they will not negotiate anything during the inspection period.  Sometimes this is a declaration from the Seller, and it is not an agreed upon term by the Buyer.   The truth is the Buyer’s only remedy is to cancel the contract during the inspection period if they are not satisfied.  Buyer’s will use the threat of cancelling to get a credit or repair or some other term they desire.   The fault in any advance agreement to “Not Negotiate  any repairs, is that often times the inspection reveals something the Buyer did not know when they went to contract.  If the Buyer would never have agreed to the price when they went to contract, it is unreasonable to expect the Buyer to simply ignore this issue.  A reasonable Seller would have to consider this new information.   How an agent handles these situations is what separates a good agent from a bad agent and a great agent.    Hire a great agent at Signature Real Estate Finder   Want to know more?  Send us an email or ask to join us on The Real Estate Finder Podcast!
