As the two major political parties engage in an arms race to weaponize the court against each other, we’ve forgotten that the proper role of the judiciary is as a third coequal branch of government, designed to check the other two from running rampant over the Constitution. Instead, we now have a political football that has broad implications for how ordinary Americans are allowed to live their lives.
