發生交通事故，常會伴隨財物的損失也有可能受傷，如果他方是有肇責責任而造成對方傷亡時，則會面臨刑事責任及民事求償。因此，若有一方有受傷，在和解或調解不成立之下，往往會在交通事故發生時起六個月內向對方提起刑事的過失傷害告訴，在檢察官起訴後再向法院提起刑事附帶民事訴訟，而利用此項制度是免繳裁判費，一般而言，裁判費的計算約百分之一。 Powered by Firstory Hosting
