In the early morning hours of January 27, 2023, 19-year-old Artesia High School senior and cheerleader Alexee Trevizo arrived at Artesia General Hospital in New Mexico complaining of severe back pain. She was with her mother. Staff administered medications, including narcotics. Shortly afterward, Trevizo used a bathroom down the hall. Hospital housekeeping later discovered the body of a newborn boy in a plastic bag inside the bathroom trash can. An autopsy determined the infant—later named Alex Ray Fierro—had been born alive, had air in his lungs, and died from hypoxia consistent with being sealed in the bag. The manner of death was ruled a homicide. Morphine was also detected in the baby’s system. Trevizo was eventually charged with first-degree murder and tampering with evidence. Prosecutors pointed to statements she allegedly made in her hospital room after the discovery, captured on police body cameras while a doctor and armed officers were present: words to the effect of “I’m sorry—it came out of me—I didn’t know what to do,” along with claims the baby showed no movement or breathing.What followed has become one of the more closely watched legal fights in recent New Mexico true-crime cases. A district court suppressed those hospital statements and related video, citing physician-patient privilege and Trevizo’s compromised medical condition (narcotics, significant blood loss, the trauma of an unexpected delivery). In a unanimous July 30, 2026 ruling, the New Mexico Supreme Court upheld the suppression.Justices described the doctor’s approach—bringing officers into the room and disclosing medical information without warning—as an “ambush” and found Trevizo lacked the capacity to waive confidentiality. Prosecutors have said they still intend to pursue the case without that evidence. The defense maintains Trevizo did not know she was pregnant until she gave birth and contests key aspects of the medical findings and hospital response. A separate wrongful-death lawsuit has also been filed against the hospital and staff on behalf of the infant’s estate.This episode examines the night at the hospital, the autopsy findings, the suppressed statements, the Supreme Court’s blistering critique of how the confrontation unfolded, and the difficult questions the case continues to raise about pregnancy denial, medical privacy, and accountability when a newborn dies under these circumstances.
