🧭 From Invention to Exit: A Patent Roadmap That Works

from Inventive Fireside | Straight Answers. Smart Next Steps.

A great invention idea is a beginning. Building something customers will buy requires a few additional ingredients, including research, development, a realistic budget, and a willingness to hear feedback that does not come with applause. In this episode, Devin Miller, patent attorney and entrepreneur at Miller IP Law, explains how the patent journey connects to the broader business journey. The conversation moves beyond filing and examination to the choices founders face before, during, and after pursuing protection. The central question is simple: what are you going to do with the invention? You might build a company, license technology, or develop a product for a future sale. Each path involves different work. Waiting for a corporation to discover your idea and arrive with a giant check is a less dependable option. 🔍 RESEARCH BEFORE YOU COMMIT Start by looking at competing products, existing alternatives, customer complaints, pricing, and purchasing habits. A product does not need an identical competitor to face competition. Customers may already solve the same problem in another way. Research should help you explain who would buy, why they would switch, and what makes your approach worth the price. 🛠️ BUILD SOMETHING THAT HELPS YOU LEARN A sketch, rendering, demonstration, or prototype can make the idea easier to understand. Choose the format based on the question you need to answer. A visual can communicate an appearance. A working prototype can test performance. Manufacturing economics and customer demand need their own evidence. Ask prospective buyers about their current behavior and purchasing process. Family encouragement is welcome, but it should not be the only item in your market research folder. 🔒 COORDINATE TESTING AND PROTECTION Customer discovery and filing strategy can move forward together. Before revealing technical details, making commercial offers, or launching publicly, discuss disclosure timing and patent options. A patentability search and a freedom-to-operate analysis address different issues. Potentially obtaining a patent does not establish that you can sell the product without infringing someone else's rights. AI may assist research, depending on the tool and its access. Verify the underlying sources and understand the limits of the search. 📅 MAKE THE FILING FIT THE BUSINESS A provisional application may be useful for some utility inventions. It can establish an early filing date for adequately disclosed subject matter and support patent-pending status. It is not an issued patent, and later improvements do not automatically receive the original filing date. Review meaningful changes rather than assuming the application grows with the product. Plan the appropriate next filing well before the usual 12-month deadline. Budget for the next stage while continuing product development. 🚀 USE THE TIME TO BUILD Improve the prototype. Investigate manufacturing. Test pricing. Develop customer relationships. Set milestones that help you decide whether further investment is justified. Just as importantly, find out whether you want to operate this business. The early stages can involve long hours, modest pay, and a surprisingly close relationship with your packaging supplier. 🏁 THINK BEYOND ISSUANCE An issued patent is a milestone. Continued innovation, customer acquisition, and execution still matter. As licensing or an exit becomes realistic, explain how the portfolio relates to the business: what it covers, why that coverage matters, and how it could support commercial value. The roadmap will change as you learn. That is a reason to revisit it, not a reason to avoid planning. Learn more about Miller IP Law at lawwithmiller.com.
