Impact of Yvanova Decision, Void Assignments, Ownership of the DEBT vs Note

Tonight on the Neil Garfield Show, I am joined by attorney Charles Marshall (CA), Dan Edstrom, chief forensic analyst for livinglies, and Jim Macklin who has guest hosted our program and been creative voice in the fight against illegal behavior by the banks.   While we be covering a few issues, the main focus tonight is to discuss the impact of the Yvanova decision by the California Supreme Court. If Jesinoski was the first punch that the banks can't recover from, Yvanova is viewed by many of the bank attorneys as the second. I agree. The Yvanova Court clears up several issues and based upon advise anda rticles from bank attorneys, it is clear that the "narrow" decision is expected to have broad impact across the country. The absurd ruling that a borrower cannot challenge a void assignment has been settled once and for all in favor of the borrower. Just as important, is that this court says that the key to any foreclosure is ownership of the debt --- not the note, not the mortgage, but the actual debt. This one statement in the Yvanova decision spells the beginning of the end for the the banks and hopefully eliminate most foreclosures. It will take a while but this represents one giant leap for all homeowners.
