from Risk Roundup · host Jayshree Pandya PhD

Vicky Shah, an Advocate, Author, Speaker, Legal Advisor, Author of the Handbook – Are You Protected, and Trainer to Police Officers in India for Cyber Crime Investigation participates in Risk Roundup to discuss the current state of Cyber Crime Investigations in India. Investigating Cyber Crimes Today, as digital data becomes a criminal’s commodity, it is driving an explosion in criminal activities, ranging from phishing to pharming, malware distribution, hacking of corporate databases, extortion, identity theft, and so on. Irrespective of nations, at all levels, the technology, tools, and processes used by cyber-criminals—are now supported by a mature cyber-crime ecosystem: infrastructure of malicious code writers, specialist web hosts, and criminal networks of hundreds of thousands of compromised computers available for automated attacks– are individually and collectively posing a direct threat to the security of not only cyberspace, geospace, and space, but individuals and entities across nations: its government, industries, organizations and academia (NGIOA). Since, the criminal threat from cyberspace has become multi-dimensional—and is increasingly targeting individuals and entities across nations: its government, industries, organizations, and academia (NGIOA) at a rapidly growing rate– combating cyber crimes has become one of the top priorities for every nation. Now, since crimes from cyberspace can be technically complex and legally intricate, rapid advances in the functionality of information and communication technologies along with inherent differences between each nation’s legal systems bring complex challenges for cyber-crime investigation.  Lack of global standards is a cause of concern. Cyber Crimes and Investigation As the sophisticated and self-sufficient underground economy from cyberspace explodes cyber-criminal activity, it is important to understand and evaluate what is a threat. Now since the globalization of cyber-crime blurs the traditional distinction between threats to geographical boundaries, and since the nature of security is changing and does not fall within any single jurisdiction for police, who is responsible for the liability of criminal networks and what are the jurisdictional challenges when addressing cyber-crimes. It is important that we all individually and collectively evaluate the state of the cyber-crime investigation in our nation. Time is now to understand and evaluate Cyber Crime investigations in each nation!
