LAL #002 — The Chauvin Trial (Part I)

from Law and Legitimacy

Focus on the Causation.  Did police officers actually cause the death of Mr. Floyd? If so, how? And if officers did, were their actions justified?   No one has been charged with intentional homicide here. The legally significant questions are what did Mr. Chauvin know and when did he know it?   Mr. Floyd was complaining that he couldn't breathe long before Mr. Chauvin kneeled on him. Don't be surprised if Mr. Chauvin is acquitted once a jury hears all the evidence. At worst, expect a compromise verdict and a conviction on third-degree murder.  This was never a case about "systemic racism" and police "murder" of men of color. That's just propaganda and sound bytes on the evening news.  The evidence will reveal an ordinary police encounter with tragic consequences. We might want to change the law of policing, but, under current law, I'd be surprised to see a conviction. Listen up and learn why. --- Support this podcast: https://anchor.fm/norm-pattis/support
