Lawsuit: Boss forced me wear a Rainbow during Gay Pride month!

from Run It By My Lawyer · host Joseph Samo

In this episode of Run It By My Lawyer, Joe Samo walks us through how judges evaluate various employment cases. June is LGBT Pride Month, and several employers are publicly supporting the LGBTQIA+ community. That causes some tension, however, when employees don't want to join in. The Tampa Bay Rays baseball team added a rainbow patch to honor and support Pride Month. Everyone except 5 professional baseball players decided to keep the rainbow patch on their jerseys and uniforms. 5 of the players stated that their faith and beliefs preclude them from showing off the rainbow patch. How would a court rule if the baseball team fired those 5 players? In a different case, a Mexican employee claims her boss was discriminating against her. Her employer is worried about firing her for poor performance for fear of being sued for discrimination. What factors would a judge and jury consider in determining if she was fired for proper reasons or for discrimination? Enjoy this episode and please keep the comments and questions coming in.
