This episode, It’s Complicated: Facebook’s Liability for Users’ Posts, poses the questions ‘When is Facebook (or any other platform) legally responsible for users’ bad behavior? And when should they be?’ The current answer is found mostly in a federal statute, 47 U.S.C. § 230, that immunizes online intermediaries from liability for most user-generated content. Section 230 is the subject of constant controversy and numerous reform proposals, but has remained largely intact since 1996. Minnesota Law’s Professor William McGeveran moderates the conversation between Danielle Citron, professor of law at the University of Virginia, and Jeff Kosseff, Associate Professor of Law at the United States Naval Academy as they try to answer the questions, “Is it time to change Section 230?
