Milí poslucháči, vitajte pri dnešnej epizóde. Predstavte si situáciu: Ste v manželstve, máte spoločný byt a jedného dňa zistíte, že váš manžel ho bez vášho vedomia predal. Znie to ako nočná mora, no žiaľ, aj takéto prípady sa stávajú. Môže však manžel legálne predať spoločnú nehnuteľnosť bez súhlasu manželky? A čo môžete robiť, ak sa vám to stane? Poďme sa na to pozrieť bližšie. Základom všetkého je koncept Bezpodielového spoluvlastníctva manželov, známy pod skratkou BSM. Toto spoluvlastníctvo vzniká automaticky uzavretím manželstva a zahŕňa všetok majetok, ktorý manželia nadobudli počas jeho trvania, s niekoľkými zákonnými výnimkami ako dedičstvo či dary. Kľúčové je, že do BSM patrí aj nehnuteľnosť kúpená počas manželstva zo spoločných peňazí, a to aj vtedy, ak je na liste vlastníctva zapísaný iba jeden z manželov. Slovenský Občiansky zákonník hovorí jasne: zatiaľ čo bežné veci môže vybavovať každý z manželov sám, pri ostatných veciach je potrebný súhlas oboch. A predaj domu či bytu rozhodne nepatrí medzi bežné záležitosti. Ide o vážnu majetkovú dispozíciu, na ktorú zákon výslovne vyžaduje súhlas oboch manželov. Ak by teda manžel predal nehnuteľnosť patriacu do BSM bez súhlasu manželky, takýto právny úkon je neplatný. Má to však jeden háčik. Nejde o neplatnosť absolútnu, ktorá by nastala automaticky. Zákon hovorí o takzvanej relatívnej neplatnosti. To znamená, že kúpna zmluva sa považuje za platnú, až kým sa manželka, ktorej súhlas chýbal, nedovolá jej neplatnosti. Právny stav takejto zmluvy teda visí vo vzduchu a je len na manželke, či podnikne právne kroky.
