Il gangster si avvalse del quinto emendamento per evitare di essere incriminato. Nonostante avesse ricorso a questa strategia legale fu gravemente colpito. Egli prima della convocazione presso la commissione del senato era riuscito a evitare molte inchieste, ma subito dopo la sua audizione fu messo al centro del mirino della commissione senatoriale, tanto che diventò uno dei principali bersagli. Molte dei suoi casinò illegali sparsi in Florida e nel resto del suo paese furono chiusi. A Saratoga Springs nel nord dello stato di New York dovette dichiararsi colpevole del reato di gioco d’azzardo illegale e pertanto venne incarcerato per tre mesi.
