Modifying the Scope of Products of Canada Subject to the Additional Duties Imposed to Offset Canadian Discrimination Against the Commerce of the United States with Respect to Alcoholic Beverages
from The White House In Audio · host Instaread Podcast
Summary: This proclamation, signed September 8, 2026, adjusts the scope of tariffs on Canadian alcoholic beverages originally imposed over Canada's discriminatory trade practices. Background: Proclamation 11046 (July 2026) imposed 50% ad valorem duties on Canadian alcoholic beverage products after finding Canada discriminated against U.S. alcohol commerce by banning/restricting its sale while not similarly restricting other countries' products. Proclamation 11056 (August 2026) briefly suspended these duties for 3 days after Canada pledged to fix the discrimination. Canada reneged on August 21, 2026, so the duties took effect August 22, 2026. New action: Unlike the motor vehicle proclamation issued the same day (which escalated to an import ban), this one keeps the tariff approach but modifies the product scope: some Canadian products are added to the 50% duty list (Annex I, Part A), while others are removed from it (Annex I, Part B). These changes take effect September 15, 2026. The tariffs continue to apply in addition to existing Section 232 duties (national security-based tariffs). The Harmonized Tariff Schedule is updated accordingly (Annex II). Implementation: U.S. Customs and Border Protection, working with Treasury, Commerce, and the USTR, will administer the changes and can make further technical HTSUS modifications as needed. Standard severability clause included.
