Nick Reiner's Grand Jury Indictment Changes the Death Penalty Math

The death penalty math in the Nick Reiner case just changed. A grand jury indictment unsealed August 12 adds lying in wait as a second special circumstance to the murder charges. The original filing carried one: multiple murders. Prosecutors now have two. If the DA pursues capital punishment and secures a conviction, the penalty phase starts with two aggravating factors instead of one. If he does not seek death, lying in wait still carries life in prison without the possibility of parole. California has a moratorium on executions, but the statute is active and LWOP sentences are enforced. The indictment alleges Nick Reiner hid his purpose from his parents, Rob Reiner, 78, and Michele Singer Reiner, 70, watched for his opportunity, and attacked them inside their Brentwood bedroom. Under California law, the lying-in-wait special circumstance requires proof of specific intent to kill, not just malice. Nick was diagnosed with schizophrenia and schizoaffective disorder years before the killings. He was under a conservatorship for grave disability from 2020 to 2021, with a fiduciary making his medical decisions. His medication was changed weeks before December 14, 2025. The prosecution's theory requires a jury to find concealment and planning in a defendant with that history. The grand jury returned the indictment on July 20 and it sat sealed for more than three weeks, bypassing a preliminary hearing that had been on the calendar.
