This after the Constitutional Court has dismissed the application by the Independent Candidates Association (ICASA) to declare the Electoral Amendment Act unconstitutional. The apex court found that the organisation failed to make a case for constitutional invalidity. The ICA contended that the 200 to 200 proportion was unfair and would be prejudicial to independent candidates. The organisation instead suggested the 350 to 50 split, however, the apex court found that it did not present a viable remedy should an overhang occur with the 350 to 50 proportion.
