At the age of 17, Cody was intubated following a traumatic car crash and struggled to breathe normally once it was removed. With the trach tube re-inserted, he was transferred to Cane Creek Rehabilitation Hospital and put under the care of a doctor who failed to consult a specialist or to provide reasonable care when Cody expressed concern and signs of respiratory distress following the second removal of the trach tube. Without the tube, Cody’s airway collapsed and he sustained irreversible brain damage, leaving him unable to speak or move.
