Justice Ketanji Brown Jackson goes further, calling the decision “an existential threat to the rule of law.”  But this isn’t just about immigration. It’s about the power shift that’s been brewing for decades. Back in 1898, the Supreme Court confirmed birthright citizenship for a Chinese American man, Wong Kim Ark — a precedent that’s shaped American identity ever since. Trump’s team argues that ruling was narrowly intended for former slaves — not today’s undocumented immigrants.  The episode also unpacks the rise of “universal injunctions,” a tool that ballooned under Trump’s first term (64 times!) and Biden’s administration (28 times).
