Two conditions, birth in the U.S., the one that Justice Roberts wants to acknowledge and Amy Coney Barrett wants to acknowledge, and being subject to the jurisdiction of the United States. What does that mean? There are three classes of people excluded. Number one, children of diplomats. Number two, soldiers from an invading army. And number three, American Indians maintaining uh tribal relations. What does that mean? You have to renounce your tribe and take up American citizenship before the child of an Indian can become an American. 02:07 In each of these categories, the status of the child depended on the status of the parent. 02:13 And you can actually go back, he writes, in the Wall Street Journal, Senator Lyman Trumbull, who managed the citizenship clause in the Senate, as they were putting this together, the 14th Amendment explained, subject to the jurisdiction meant, quote, not owing allegiance to anyone else, unquote, whether to a tribe or a foreign power, quote, unquote. 02:41 You could not be subject to a foreign power when you gave birth to the baby.
