Most car accident cases that end up in court are usually tried in front of a jury and insurance companies prefer juries because they think juries are less likely to trust people who have been hurt in a car and less likely to award them money. Andrew will discuss three pieces of law in Ontario that affect the compensation an injured party can receive following a car accident, but which are hidden from juries during a trial. These laws include the deductible, which requires the judge to reduce the jury's award of damages outside of the presence of the jury; the cap, which limits the amount of money people in Ontario can recover for pain and suffering; and the threshold, which allows the insurance company to ask the judge to second-guess the jury's decision to award compensation to an injured party. These laws are stacked against the victim of the injured party to drive down the value of the case and make it difficult for them to receive fair compensation.
