The implications of Dudu Myeni's State Capture testimony.
from African Dialogue · host Channel Africa
The past two weeks the State Capture Commission of Inquiry has been focussing on testimonies about the running of state owned entities namely; failed state airline South African Airways. Former SAA technical board chair Yakhe Kwinana is alleged to have received millions of rand in kickbacks in exchange for lucrative contracts from SAA to JM Aviation but Kwinana maintained she did not have a personal financial interest with the company. Her testimony was followed by former SAA board chairperson Dudu Myeni’s shocking revelation of witness identified by the commission as ‘Mr X’. By doing so Myeni violated the commission’s regulations which give an order not to identify him as he fears for his safety. During her testimony she named Mr X several times even after Justice Raymond Zondo warned her not to do so. So what are the legal ramifications of defying the State Capture commission's regulations? Meanwhile the commission has threatened to lay a charge against Myeni for breaching Section 5 of the Commission’s Act. To assist us on this we are joined by: • Cathleen Powell is an Associate Professor in Public Law at the University of Cape Town• Levy Ndou is a political analyst
