The Power Of Mediation In Family Law

from The D Shift

This is a fascinating episode where my guest, Judith Kaluzny, shares how her own divorce after 17 years and with 7 children spurred her on to become an attorney and to advocate for divorce settlements through mediation rather than litigation.Judith Kaluzny shares her expertise in the field of family law, including how the legal system may contribute to conflict throughout the divorce process. As a former family law attorney and mediator, as well as the author of the book, "The Marriage License Handbook”, she is uniquely positioned to offer this evaluation. Judith shares her insight and why she moved from being an attorney to becoming a mediator and advocating for couples going through divorce. We discuss the underutilization of mediation in the court system, the importance of prenuptial and postnuptial agreements, and the evolving understanding of domestic violence. This episode provides valuable insights and practical advice for those navigating the complexities of divorce and relationships. So, sit back, relax, and get ready to understand the complexities of family law and why mediation is such a valuable tool. About the Guest: At the age of 20 Judith Kaluzny married, had seven children, and upon divorce, went to law school. Before moving to California, she was a journalist for a while with the Menominee Falls (Wisconsin) News and Milwaukee Journal-Sentinel. She mainly practiced family law for 43 years. Early on, Judith did a few minor criminal cases and two federal civil rights cases, one with 56 plaintiffs. After 10 years of litigated cases, she learned about mediation. Judith soon gave up going to court and helped couples through family problems, mostly dissolution of marriage--as they call divorce in California. Just before the COVID pandemic hit, she had decided to hang up my shingle and devote myself to writing. Judith wrote The Marriage License Handbook, rules of the road for getting married, small, like the Drivers License Handbook. Next will be The American Way of Divorce, a Fraud on Families.
