On January 24, 2023, Lindsay Clancy killed her three children inside the family's home in Duxbury, Massachusetts. There is little dispute over who committed the killings. The question now being decided in a Massachusetts courtroom is far more complicated: Was Lindsay Clancy legally responsible for what she did? Her defense argues that Clancy was suffering from severe mental illness, including postpartum psychosis and bipolar disorder, and could not appreciate the wrongfulness of her actions or conform her behavior to the law. Prosecutors argue that the evidence shows something very different: planning, calculation, opportunity, and an understanding of what she was doing. This case forces us into one of the most uncomfortable questions in criminal justice: Can an act be intentional without the person committing it being legally responsible for it?
