Trial By Jury In Civil Cases-Federalist no. 83

In this paper, Hamilton supports the absence of a provision for trial by jury in civil cases. Hamilton cites the complexity of civil law and the differences of law in individual states. Therefore, Hamilton asserts that this power is left up to state jurisdiction and if further implementation is needed in the constitution the federal legislature will act upon it. Hamilton alludes to the unequivocal utilization of trial by jury in criminal cases in the constitution with full support.
