Send us Fan MailLast night at 11:53 p.m., U.S. District Judge Carl J. Nichols signed a 24-page memorandum opinion in DSCC v. Trump. He granted a preliminary injunction blocking the Postal Service’s final rule, “Ballot Mail for Federal Elections.”That rule grew out of Executive Order 14399. It required USPS-approved envelopes and a new Federal Ballot Mail Portal. States would upload mail-voter data. Ballots would go only to people on a State-specific Mail-in and Absentee Participant List. No portal entry, no delivery.In May, the same judge refused to block the executive order because no final rule existed yet. After USPS published the rule in late August, the plaintiffs came back. Nichols granted the freeze.His holding is narrow and statutory. The government conceded USPS can issue the rule only if Congress authorized it. Nichols found no statute that lets the Postal Service impose election procedures on states, stand up a voter data system, or refuse otherwise lawful ballot mail. The Postal Reorganization Act covers moving the mail. It does not cover running a national absentee gate. He rejected the comparison to rules for cremated remains and replica explosives.He also found the timing too late. Early ballots are already in the pipeline. The record, he wrote, shows the rule would make mail voting harder and raise the risk that lawful absentee ballots never get counted. The administration did not put in evidence of significant fraud that would justify the disruption.This is not a final trial verdict. It is a preliminary injunction. A separate Boston injunction is already at the Supreme Court.
