VIDEO! The Deadly Limits on Open Carry!
from The Andrew Branca Show · host Attorney Andrew F. Branca
An Ohio police officer responds to a call of a man walking around a residential neighborhood pointing a gun at homes. As the officer pulls up, he sees a suspect that matches the description called in. The officer begins to verbally engage with the suspect--and within seconds has fired a shot as he spots an apparent gun in the suspect's hand. The apparent gun would later be determined to be a toy. Ohio happens to be an Open Carry state, meaning it is lawful to openly carry a firearm in public. Does that make this officer's shooting of this suspect unlawful? What if it is determined that the suspect had only the most innocent of intentions in possessing that apparent gun.
