Ukraine’s constitutional structures have regularly been revised since its independence. While it was already moving on a path towards closer association with Europe, new urgency for progressing EU membership presents a significant challenge for Ukraine to bring its laws, governance structures, and judiciary in line with highest international standards, including in the field of human rights protections. In this discussion, Dr Svitlana Khyliuk from the Ukrainian Catholic University in Lviv, Ukraine will speak to Dr David Kenny about Ukraine’s possible constitutional futures after the war; the challenges of aligning Ukraine’s legal system with that of the EU; Ukraine’s identity and its place in Europe; and the ongoing war and how it impacts on her work. Dr Svitlana Khyliuk is an associate professor and director of the law school at the Ukrainian Catholic University in Lviv, Ukraine. Dr. Khyliuk has been a legal expert in the projects of the Organization for Security and Cooperation in Europe (OSCE) Project Coordinator in Ukraine, the Council of Europe, and the U.S. Department of Justice in relation to projects in Ukraine. She is a member of the Scientific Advisory Board of Ukraine’s Supreme Court and Constitutional Court. She teaches Criminal law and Law of the European Convention on Human Rights. Dr David Kenny is an Associate Professor of Law and Fellow at Trinity College Dublin, teaching and researching Irish and comparative constitutional law and law and literature. He has been involved with various constitutional reform processes in Ireland, giving evidence to, amongst other bodies, the Citizens' Assembly and Oireachtas Committee on the 8th amendment. He has also been involved in constitutional futures and/or constitutional mapping projects in the Northern Ireland, the Korean Peninsula, and Ukraine.
