The full self-driving (FSD) software is a major improvement, however, it cannot (yet) be categorized as Level 3 autonomy. According to the National Highway Traffic Safety Administration (NHTSA), “the major distinction between L2 and L3 is that at L3, the vehicle is designed so that the driver is not expected to constantly monitor the roadway while driving.” Since drivers are expected to constantly monitor the road at all times during beta tests of Tesla’s FSD software, the vehicles are not quite at Level 3, though they're certainly moving in that direction.
