I’m joined by Amy Swearer, senior legal fellow at the Heritage Foundation, who has written scholarly papers showing conclusively that the plain meaning of the 14th Amendment was not adopting unqualified birthright citizenship for foreigners and most certainly not for illegal aliens and temporary visitors. The entire philosophy of citizenship, both pre- and post-adoption of the 14th Amendment, was built upon consent and allegiance. Amy explains why Wong Kim Ark expresses a false view of history but at the same time is clear that birthright citizenship cannot apply to those here against the national consent.
