In the final hours before Judge William Sullivan declared a mistrial in the Lindsay Clancy murder trial, defense attorney Kevin Reddington asked the judge for a one-hour pause. He used the time to file an emergency petition with the Massachusetts Supreme Judicial Court, arguing the lone holdout juror was biased against people with mental illness and had refused to follow the court’s instructions on reasonable doubt. Justice Dalila Argaez Wendlandt held a brief hearing over Zoom. The court denied the petition. Sullivan declared the mistrial. The emergency filing was the last in a series of moves Reddington made during the final days of deliberation. He asked Sullivan to dismiss the holdout. He asked the judge to survey the panel on lesser charges. He argued the foreperson’s notes showed the holdout was intractable. Sullivan declined each request. Clancy had pleaded not guilty to three counts of first-degree murder in the deaths of Cora, 5, Dawson, 3, and Callan, 8 months. The jury split eleven to one after seven days. The prosecution had argued during the trial that Clancy’s fall from a second-story window was not a sincere attempt, a characterization the defense used to argue the prosecution had alienated the panel.
