Last year, Jordan Neely, a homeless street performer (and Black, as the media reminds you), intimidated and acted aggressively towards fellow subway passengers in New York City. One of those passengers was Daniel Penny, a former Marine (and White, as the media reminds you), who stepped in and put a chokehold on Neely for about six minutes. Penny says he only wanted to protect fellow passengers and restrain Neely until police arrived. Unfortunately, Neely died, either from the chokehold or other factors as Penny's lawyers argued. Whatever the cause, the Manhattan DA's office charged Penny with manslaughter and criminally negligent homicide.
