They Keep Saying They'll Get to It. Most Never Do
A new IG Wealth Management study found that 84 percent of Canadians say estate planning is a priority. But only 41 percent have a plan. In this episode I talk about what's actually getting in the way, because it isn't a lack of awareness. People know they should do this. The real blockers are subtler: not knowing where to start, not having sorted out what they want before they try to formalize it, and the very human tendency to avoid thinking about death or incapacity.I also talk about what a real first step looks like, and why it isn't a lawyer's appointment.Read the full article. They Trusted You. The Court Will Judge You.
Most people who agree to be an executor do it because someone they love asked them to. What nobody tells them is that the moment they say yes, they're held to a specific legal standard, with real consequences if they fall short. In this episode, I'm talking about the executor standard: what it actually is, what it covers, and what a real 2026 BC Supreme Court case shows happens when it isn't met.We get into what "reasonably skilled person acting in afiduciary capacity" means in plain language, the five areas courts look at when evaluating executor conduct, and why not knowing about the standard doesn't protect you from it.If you've been named as an executor, or someone has askedyou to take on the role and you're not sure what you'd be agreeing to, this one's for you.Read the full article and find the tools mentioned.Disclaimer: This content is for general information only and is not legal, financial, medical, or tax advice.

Will Ready Is Not Estate Ready
Having a will and having a ready estate are two different things, and most executors find that out in the first week after a death. In this episode I talk about what that week actually looks like from inside an executor's role, where solutions exist, and what genuinely prepared looks like in practice. If you have people who depend on you, or if you'll ever step into an executor role yourself, this one is worth your time. I'll Be Dead Anyway
A friend said three things to me recently that I’ve heard more times than I can count. “I’ll be dead, so it won’t be my problem.” “I know my kids, they won’t fight.” “If my spouse wants to deal with it after I'm gone, that’s up to her.”He has a will. He has five kids. He feels like he’s handled it. But his will passes everything to his spouse with no direction about personal property and no conversation on record about who gets what.In this episode, I go through all three of those statements, because each one sounds like a reasonable position and each one is actually a planning gap dressed up as indifference. The research is striking. More than half of estate disputes involve items worth less than ten percent of the total estate. Not the money. The stuff. And families that look just fine while a parent is alive can find themselves in conflict they never saw coming once that person is gone. This one is for anyone who has said these things, or loves someone who has.Read the full article.

Could Your Child's Ex Inherit From You?
What happens to an inheritance when the beneficiary is going through a divorce? It's a question that comes up more and more in estate administration, and the answers aren't always intuitive. In this episode, I'm walking through how inherited assets can lose their protected status, why the timing of executor distributions matters, and what parents can do when designing an estate plan that reflects how families actually operate under stress. My estate planning and executor resources, are at agapimarketing.com/planning-toolkit/Read the full article.#EstatePlanning #EstateAdministration #NEXsteps #InheritanceAndDivorce #ExecutorTips #CanadianEstatePlanning

Why a Basic Will Isn't Enough for Blended Families
Blended family estate planning is one of the most misunderstood areas I see in estate work, and the cost of getting it wrong doesn't show up until after someone has died.In this episode, I'm talking through why the "leave everything to my spouse" approach so often backfires, how executors end up in the middle of conflict they didn't create, and what families in second marriages or common-law relationships actually need to be thinking about. If you've been putting off revisiting your estate plan after a major life change, this one's for you.Read the full article.

When Death Has A Date
When death has a date, you'd think the estate would be inorder. But that's not usually how it goes.MAID, or medical assistance in dying, gives Canadians the legal option to choose the timing of their death. And that changes the estate planning conversation in ways most people haven't considered. In this episode I'm walking through what MAID means for your documents, your executor, and your family. Not the medical side, not the policy side, but the practical side. What needs to be in place and why capacity timing matters more than most people realize. What a personal directive can and can't do, including one thing that surprises a lot of people. What the executor is really walking into when death is anticipated rather than sudden. And what families should be thinking about when someone they love is living with a serious illness. This one's worth a listen whether you're thinking about your own planning or supporting someone who is.Full article here.Disclaimer: This content is for general information only andis not legal, financial, medical, or tax advice.#EstatePlanning #MAID #EndOfLifePlanning #nexsteps #IncapacityPlanning #CanadianEstatePlanning #Executor #PersonalDirective

Could The Golden Girls Retire in Canada?
A GOBankingRates article came out this week asking what the Golden Girls' retirement would look like in today's American economy. I loved it so much I ran the same exercise through a Canadian lens. CPP, OAS, TFSAs, provincial health coverage, and Victoria real estate instead of Miami. The numbers are illustrative, but the conversation is real. The biggest retirement advantage Canada has over the US isn't any single pension program. It's the healthcare bill that simply doesn't exist here.I'm not a retirement planner, but estate planning is my world, and the two are more connected than most people realize. Everything you build has to go somewhere. That part of the plan deserves just as much attention.Read the full article. This content is for general information only and is notlegal, financial, medical, or tax advice.#GoldenGirls #CanadianRetirement #EstatePlanning #CPP #OAS

You’re Not Too Young for Estate Planning
If you're in your 20s or 30s and you haven't sorted out yourestate planning yet, you're not alone. Most people in this age group have it on the list somewhere between "call the dentist" and "learn to make sourdough." It doesn't feel urgent. It feels like something for later. This week's episode is about what later actually looks like when it arrives unexpectedly. We talk through what happens when a young adult loses capacity or dies without a will or incapacity documents in place and why the people who love them most can end up completely powerless despite the best intentions. We also cover why singles and childfree adults are more exposed than they realize, why common-law relationships carry legal assumptions that aren't true in most provinces, and why the incapacity documents are the ones most young people have never thought about at all.If you've been waiting until life feels more settled to deal with this, this episode is your sign that settled enough is right now.Read the article.

You Can Get Paid For That: What Executors Need to Know About Compensation
Executor compensation is one of the most misunderstood topics in Canadian estate administration. Most family executors don't know they're entitled to it. Most beneficiaries don't know it comes out of the estate. And almost nobody has the conversation before it's too late to have it without conflict. This episode covers how compensation is calculated across provinces, the tax implications that tend to catch people off guard, why this is such a common source of estate disputes, and what those planning their estates and executors alike should be doing differently. Before the Window Closes: Cognitive Decline and the Cost of Waiting
This episode looks at one of the most avoidable crises inestate planning: losing the window to put your planning documents in place before cognitive decline takes it away.In Canada, signing a Power of Attorney or personal care directive requires legal capacity. Once that capacity is gone, the documents can't be signed, and families are left navigating a court process that's expensive, slow, and emotionally exhausting. This episode walks through why the early stages of cognitive decline are often missed and why the financial abuse risk during that window is real. The Gap in Most Estate Plans
Most people think a will covers everything. It doesn't. A will only takes effect after death, which means it does nothing if you're still alive but unable to manage your finances or make healthcare decisions. This episode looks at the two documents that fill that gap,why so many families are caught off guard without them, and what complete estate planning actually looks like.Read the full article here: https://agapimarketing.com/estate-planning/the-gap-in-most-estate-plans-and-how-to-close-it/Disclaimer: This content is for general information only andis not legal, financial, medical, or tax advice.#EstatePlanning #PowerOfAttorney #PersonalDirective #IncapacityPlanning #WillsAndEstates #nexsteps

Settling My Own Estate?
What would it feel like to settle your own estate while you're still very much alive? A friend of mine found out firsthand when she made the decision to move abroad. Suddenly she was sorting through decades of her life, deciding what to sell, what to give away, and what to let go of entirely. It sounds practical. And it is. But it's also something else entirely. Because when you're forced to hold every object you own and decide whether it comes with you into the next chapter, you find out pretty quickly what you actually value versus what you've just been carrying around out of habit or guilt or inertia. In this episode I'm sharing her story and what it reveals about all of us. Hope Is Not a Strategy: Why a Will Isn't Enough
Most people don’t put off estate planning because they don’t care. More often, they put it off because they believe there is still lots of time and hope things will work out if something does happen. In this episode, I talk about why hope is not a strategy when it comes to estate planning. A will is important, but it doesn’t help during incapacity. If someone is still alive but unable to manage finances or communicate medical wishes, the family may need very different documents inplace.I cover the role of enduring powers of attorney and medical directives, the burden that can fall on families when no one has clear authority, and why planning is about more than paperwork. It’s about clarity, protection, and making life easier for the people who may one day need to step in.Read the full article.#nexsteps #estateplanningDisclaimer: This content is for general information only and is not legal, financial, medical, or tax advice.

Can you really “disinherit” the CRA?Well, not exactly. But you can take steps to reduce unnecessary tax, avoid preventable mistakes, and make sure your planning is working the way you think it is. The Butterfly Effect of Estate Planning
We often think estate planning is shaped by the biggest decisions, but that's not always what creates the biggest consequences later. In many cases, it is the smaller details, those that seem easy to leave for another day, that end up changing everything for the people left behind. In this episode, I talk about the butterfly effect and why it's such a powerful way to think about estate planning. A small omission, a delayed conversation, or a decision made without enough thought can have a much larger impact later than most people expect. The opposite is true as well. A small, thoughtful action today can make things much easier for an executor and for a family down the road. This is a reflective conversation about legacy planning, practical preparation, and why the details matter more than people often realize.Read the full article.Disclaimer: This content is for general information only and is not legal, financial, medical, or tax advice.#nexsteps

When An Inheritance Needs Guardrails
When an inheritance involves minors or vulnerable beneficiaries, structure matters. In this week's episode and article, I explain how trusts for minors work, why staged payouts are often preferable to lump-sum distributions, and how dependent protection planning can preserve stability for beneficiaries receiving disability support. We also explore trustee duties and executor exposure. Many people agree to act without realizing the long-term administrative and fiduciary responsibilities involved. If your estate plan includes minor children or adult dependents, this discussion will help you understand what thoughtful planning actually looks like.Read the full article.Disclaimer: This content is for general information only and is not legal, financial, medical, or tax advice.#nexsteps #trusts #estateplanning #executor #familyprotection

The Flip Side of Beneficiary Designations
When someone writes a will, they usually assume the plan is complete. But many assets never pass through the will at all.Registered accounts and insurance policies often have beneficiary designations attached to them, and those forms can override what the will appears to say. When the paperwork is not aligned, the result can be confusion, unequal outcomes, and difficult explanations for the executor. In this episode, I talk about the flip side of beneficiary designations and why this issue shows up more often than people expect during estate administration. The documents are usually valid. The intentions were good. The problem is simply that the forms and the will were never reviewed together. If you have not looked at your beneficiary designations in a while, it may be worth confirming that everything still fits with the rest of your plan.Read the full article to learn more.Learn more at https://nexsteps.ca/Disclaimer: This content is for general information only and is not legal, financial, medical, or tax advice.#nexsteps #beneficiaries #probate #estateadmin #financialplanning

AI: Executor Superpower or Liability?

What You Need To Know About Probate
Probate is often talked about as if it’s something to fear or avoid at all costs. But did you know that it can also be a thoughtful way to plan ahead and use the tax rules to your advantage?
