In the following cases a dismissal will be deemed to be an automatically unfair dismissal, regardless of whether the employee hascompleted the normal qualifying period for an ordinary unfair dismissal claim (section 108(3)-(5), Employment Right Act 1996(ERA 1996); section 154, section 239 and paragraph 164, Schedule A1, Trade Union and Labour Relations (Consolidation)Act 1992 (TULRCA); section 12(4), Employment Relations Act 1999 (ERelA 1999)).
