E2 Visa Approvals Hit All-Time High in 2023 The United States issued an all-time high number of E2 investor visas in the 2023 fiscal year - nearly 54,000 - according to a new article by the Investment Migration Insider. That’s a 20% increase over the preceding year. Significantly, Canada emerged as the largest source of E2 investor visa applicants in the Western Hemisphere. In South America, Colombian E2 visa approvals almost quadrupled, and Chileans saw a nearly six-fold rise. Other countries with a large number of E2 visa approvals last year include Japan, South Korea, Taiwan, Germany, and the United Kingdom. Watch Out for Virtual Office Addresses If Your LLC Is Foreign-Owned If you are a non-citizen who wants to establish a limited liability company (or LLC) in the United States, do you realize that a big U.S. bank can and likely will suddenly close your account if they discover that you are using a virtual office as your principal business address? There are some smaller U.S. banks that don’t care if your foreign-owned LLC has a virtual address. But large U.S. banks tend to require that foreign-owned LLCs have a physical business address - that is, a real office address or home office address - and will not accept anything less, including relatively expensive virtual office arrangements with companies like Regus. They apparently use a technology that periodically checks the business address you provide online. And if the bank determines that your address is virtual, you’ll be notified and, if corrective action isn’t taken, they’ll close your account. New Corporate Transparency Act Could Cost Your LLC or C-Corp $500 Per Day in 2024 Breaking News! The Corporate Transparency Act (or "CTA") will cost you $500 per day—and up to two years in prison—if you own a US company and violate the new rules. This federal law came into effect on January 1, 2024 and requires companies that are registered to do business in the United States to disclose information about their beneficial owners. There are some limited exceptions, but if you have an LLC, C-corp, limited partnership or similar entity doing business in the United States, the new law applies to you. Congress passed the CTA to combat money laundering, terrorist financing, corruption, and tax fraud in the United States. In short, you need to provide identifying information about the corporate entity and its owners to the U.S. Treasury's Financial Crimes Enforcement Network (or "FinCEN"). If you formed your U.S. company before January 1, 2024, then you have until January 1, 2025 to meet the reporting requirements. However, if you establish your U.S. company in 2024, you have only 90 days to provide your beneficial ownership information. The information you provide will not be publicly available on any database, but the U.S. government will have it, of course. Finally, please note: If you willfully fail to file, you will be required to pay a fine of $500 per day up to $10,000 and/or spend two years in prison. 4 Visas to Start Your Own Business in the United States in 2024 Here are 4 visas to help you start and manage your own business in the United States. But first, please note: You don't need a visa to merely start a U.S. business as a non-citizen. You can do that without a visa and manage it from abroad. And, if you like, you can hire Americans or others with a work visa as employees of your company in the United States. But if you want to start, manage and work for your U.S. company while you're in the United States, you'll need a work visa, and here are 4 good ones: 1. The E2 visa If you're willing to invest a substantial amount in a new US business—typically at least $100,000—and then direct and grow it, the E2 visa may be for you. You can invest in almost any kind of business, but you aren't eligible for an E2 visa unless you're a citizen or national of an E2 treaty country. 2. The E1 Visa If you engage in substantial trade between their home country and the United States, and your country is included on the list of E1 treaty trader countries, you may be eligible for an E1 visa. 3. The L1 Visa If you have a company abroad, you can open a subsidiary, branch, or affiliate company in the United States. Unlike an E2 or E1 visa, you don't need to be a citizen or national of a treaty country. It can be challenging for applicants who own small businesses to obtain an L1 visa, however, because they're typically issued to large companies that transfer high-level employees internationally. 4. The EB5 Visa If you invest $800,000 to $1 million in your own U.S. business and it creates 10 full-time American jobs, you can live and work in the United States. And, unlike the 3 visa options mentioned previously, you'll qualify for a green card. Over 90% of EB5 applicants invest through an EB5 regional center with other investors because it's a lot simpler, but you can get an EB-5 visa through a direct investment in your own business as well. 2 Questions to Ask about Your E2 Visa (Treaty & Reciprocity) An E2 visa is an investor visa granted to entrepreneurs who want to start or buy a business in the United States. It's a great visa, but not every foreign entrepreneur can or should apply for it. Here are 2 preliminary questions to ask in order to find out whether you're one of the lucky ones: 1. Am you from an E2 treaty country? You're not eligible for an E2 investor visa as the principal applicant unless you're a national or citizen of an E2 treaty country. To find out if you are, Google "E2 Treaty Countries" and check out the official list on the U.S. State Department website. 2. How long is your initial E2 visa likely to be valid? To find out the likely initial valididy period of your E2 visa if it's granted, Google "Visa Reciprocity Schedule" to check out the official U.S. State Department website. For example, if you're from Canada, click on the letter "C" in the left-hand column. Then click on Canada. Then, under Visa Classifications, click on the letter "E." Then can see that the initial length of your E2 visa is likely to be 60 months (or 5 years) if you’re a Canadian national. However, while it's common for E2 visas to be issued initially for 5 years, many countries have shorter periods based on whether they offer "reciprocal" benefits to Americans seeking a visa abroad. So it's important to determine the initial validity period of your E2 visa if it’s granted, even though you can renew it indefinitely as long as your E2 enterprise continues to operate and grow. Finally, please note: Even if the initial validity period of your E2 visa is much shorter - let's say 1 year, for example - you will be granted 2 years of legal "status" in the US each time you enter the country with your E2 visa. Utah Eases Licensing Requirements for Foreign Professionals Did you know that the State of Utah has made it easier for foreign professionals to get licensed and get to work in the United States? Utah State Law SB35 permits 9 state departments to issue licenses to foreign professionals who can prove that they have the requisite skills and experience to perform the jobs in Utah. And for professions with license portability between states, the law even opens a door to professionals living outside of Utah. To qualify, foreign applicants must show that they are lawfully present in the United States and carry an equivalent foreign license in one of the long list of eligible professions. So the new law is welcome news for many internationally trained professionals, but please note: A professional license is not the same as a work permit. The R1 visa category applies to a wide range of religious workers, including priests, nuns, ministers, religious educators, translators, and missionaries. To be eligible, you must have a job offer from a tax-exempt religious organization in the U.S. that qualifies for the program, but a lot of them are hiring these days. 3 Phases of the E2 Investor Visa Process in 2023 Phase 1: The Investment and Supporting Documentation During phase 1, we work together with you to gather and organize all of the documents about you, your new U.S. business, and your investment therein that are needed to satisfy the requirements of an E2 visa. This phase typically lasts at least 4 four months but can take considerably longer depending on how much time you need to make the requisite investments in your E2 enterprise, open the business (preferably with at least one employee), and provide the supporting documentation. Phase 2: The Application In this phase, we prepare your E2 visa application. It normally takes about 30 days but can be expedited upon request or if necessary. And when it's ready, we submit your application to the U.S. embassy or consulate in your home country or, in some cases, USCIS. Phase 3: The Interview If your E2 visa application was submitted to a U.S. embassy or consulate abroad, an official will typically send you a notice in 1 to 3 months about when your interview will take place. Timing can vary significantly, however. Once your E2 visa interview appointment is made, we’ll schedule a call with you shortly before the interview date to discuss the process and ensure that you’re ready to answer questions and make a great impression. E2 visa interviews typically don't last more than 10 minutes or so, and the consular official will usually tell you whether or not you’ll get the visa when it's over. If you've been approved, you'll leave your passport at the embassy, along wit the passports of any derivative family members. Then, in about week or two, you'll receive your passports in the mail, along with the E2 visas. At that point, you’ll be free to travel to the United States and begin working for your E2 enterprise. Therefore, you can expect the 3 phases of the E2 investor visa process to last between 6 to 10 months in most cases. Breaking News: New Family Reunification Parole for Ecuadorians USCIS has announced the implementation of a new family reunification parole ("FRP") process for certain nationals of Ecuador. The process allows an eligible beneficiary to be considered for parole into the United States on a case-by-case basis while they wait for their family-based immigrant visa to become available It's available by invitation only to certain petitioners with an approved green card petition on behalf of an Ecuadorian beneficiary. More specifically, the Department of State’s National Visa Center (NVC) will begin issuing invitations to certain U.S. citizen or lawful permanent resident petitioners whose Form I-130 on behalf of an Ecuadorian beneficiary has been approved. When a petitioner receives one of these invitations, they can begin the FRP process by filing Form I-134A, Online Request to be a Supporter and Declaration of Financial Support, and requesting to be a supporter of the principal beneficiary and any derivative beneficiary spouse and children. The beneficiaries may then be considered for advance travel authorization to travel to the United States to be considered for a discretionary grant of parole. Noncitizens paroled into the United States under this process will usually be considered for parole for up to three years and can request employment authorization while they wait for their immigrant visa to become available. And, of course, they may apply to become a lawful permanent resident when their immigrant visa becomes available. Finally, please note: Petitioners must receive an invitation from the NVC before filing Form I-134A under this process. 4 REQUIREMENTS OF AN EB2 NIW VISA Here are the 4 requirements of an EB2 National Interest Waiver (“EB2 NIW”) visa, which does not require a job offer and grants you permanent residency in the United States: 1. Your proposed endeavor in the United States must be of "substantial merit and national importance." 2. You must be "well-positioned" to execute and advance your proposed endeavor 3. It must be in the national interest of the United States to waive the typical job offer and labor certification requirements of an EB2 visa 4. You must have the foreign equivalent of an advanced degree or exceptional ability in your field Please also note that USCIS now offers premium (or expedited) processing of EB2 NIW petitions for an additional fee. APPLY FOR YOUR US VISA BEFORE NEW RESTRICTIONS ARE IMPOSED If you're planning to apply for a U.S. visa or green card, consider doing it sooner rather than later because former President Trump has promised a crackdown on immigration if he returns to power in 2025. And so has his closest rival for the Republican presidential nomination, Florida Governor Ron DeSantis. Even Robert Kennedy Jr., who is now running for president as an independent, has signaled that significant restrictions are coming. Regardless of who takes over for Biden—assuming it's not another open-borders Democrat—the main focus of any new changes will undoubtedly relate to illegal immigration and bogus asylum claims. Personally, I think such changes are necessary and long overdue. But American disgust at the Biden border crisis may lead to restrictions on certain types of legal immigration, too. So, you can take your chances and wait to see what happens. Or you can apply for your U.S. visa now, as I've suggested. 2 EB5 INVESTOR VISA TRAPS Here are two EB5 investor visa traps to avoid. And the second one is super-important. So wait for it. First, under new EB5 reform regulations, if you're interested in obtaining your EB5 visa through a DIRECT investment in your own project, you must be the sole investor in it. Otherwise, you MUST use an EB5 Regional Center project to make your investment. Second, if you knowingly or unknowingly use an unregistered broker, agent, or promoter to select your EB5 project, and that person is paid a commission for your investment therein, USCIS can deny your EB5 petition on that basis. So, if you're dealing with a foreign broker, agent or promoter, make sure they’re a USCIS-licensed agent. Or, if you're dealing with a US broker, agent, or promoter, make sure they're a FINRA licensed broker. This is trickier than you think because you may not realize that you're dealing with an unregistered agent. Maybe you searched for a great EB-5 project on your own and went to the website of an unregistered agent who earned a commission for the referral, and you had no idea. That may be enough for USCIS to deny your visa. So ... be very careful if you're searching for EB5 projects on your own and, better yet, enlist the services of a US-based FINRA-licensed broker.
