È territorio spagnolo e, quindi, rappresenta una frontiera esterna dell’Unione europea.Le immagini diffuse in queste ore sono impressionanti. Gruppi numerosi di persone tentano di raggiungere il territorio spagnolo via mare o superando le barriere di confine, mettendo sotto pressione le forze di sicurezza e le strutture di accoglienza.Non siamo davanti soltanto a una questione umanitaria. Siamo davanti a un problema di sovranità, sicurezza e credibilità politica.Quando una frontiera viene attraversata in massa e lo Stato non riesce a controllarla, il messaggio che arriva all’esterno è evidente: l’Europa può essere messa alla prova e, almeno temporaneamente, può perdere il controllo del proprio territorio.In questo contesto assume particolare rilievo la politica del Governo spagnolo guidato da Pedro Sánchez, che ha promosso una vasta regolarizzazione degli stranieri già presenti irregolarmente in Spagna.Naturalmente, una regolarizzazione rivolta a chi si trova già sul territorio non attribuisce alcun diritto a chi entra oggi. Ma le politiche migratorie non producono soltanto effetti giuridici. Producono anche aspettative.Se uno Stato regolarizza un numero molto elevato di persone senza dimostrare, nello stesso tempo, di essere capace di controllare le frontiere e rimpatriare chi non ha titolo per restare, il rischio è che l’irregolarità venga percepita come una fase temporanea verso una futura legalizzazione.Non possiamo affermare che la sanatoria abbia provocato direttamente ciò che accade a Ceuta. Sarebbe una conclusione troppo semplice. Possiamo però sostenere che Sánchez abbia trasmesso un segnale politico di debolezza proprio mentre la frontiera europea era sottoposta a una crescente pressione.Il paradigma Integrazione o ReImmigrazione propone una linea diversa.Chi entra regolarmente e ha diritto di restare deve essere inserito in un percorso serio, verificabile e responsabile di integrazione. Chi invece entra senza titolo, non ottiene protezione e non possiede altre ragioni giuridiche per permanere deve essere rimpatriato.Non può esistere integrazione senza controllo degli ingressi.     La Corte Suprema italiana afirma que la integración debe contar en las decisiones de expulsión Bienvenidos a un nuevo episodio del podcast “Integración o ReInmigración”.Soy el abogado Fabio Loscerbo y hoy vamos a hablar de una decisión muy importante de la Corte Suprema italiana que puede ayudar a comprender cómo está cambiando el debate migratorio en Europa. Se trata de la orden número 13955 del 13 de mayo de 2026 dictada por la Corte Suprema de Casación italiana. La cuestión central es muy simple: cuando un extranjero se enfrenta a una expulsión, ¿el Estado debe mirar únicamente su situación administrativa o también debe valorar su nivel real de integración dentro de la sociedad? El caso afectaba a un ciudadano albanés contra quien se había ordenado una expulsión inmediata en Italia. Antes de esa medida, la persona había solicitado oficialmente lo que el derecho italiano denomina “protección complementaria”. Para el público español e hispanoamericano es importante entender que este concepto no coincide exactamente con el asilo tradicional. En Italia, la protección complementaria permite a los jueces considerar elementos como la vida privada y familiar, la integración social, el trabajo y los vínculos desarrollados dentro del país. El juez de primera instancia había tratado al interesado simplemente como un inmigrante en situación irregular. Pero la Corte Suprema italiana adoptó una posición completamente distinta. La Corte afirmó que los jueces deben analizar también las relaciones familiares, la integración laboral, la situación personal concreta y el nivel de arraigo social antes de confirmar una expulsión. Y precisamente ahí reside la importancia de esta decisión. Porque la Corte rechaza dos posiciones extremas. Por un lado, no defiende una inmigración sin límites ni un derecho automático a permanecer en el territorio. Pero, por otro lado, también rechaza una lógica puramente automática y burocrática de la expulsión basada únicamente en documentos y permisos administrativos. La Corte parece abrir una tercera vía: distinguir entre quienes han desarrollado una integración real dentro de la sociedad y quienes no lo han hecho. Y este es exactamente el núcleo del paradigma “Integración o ReInmigración”. La idea es sencilla: la integración debe tener valor. No como un simple discurso político, sino como un criterio jurídico y social concreto. El trabajo importa.El respeto de las normas importa.La integración familiar importa.La participación social importa. Esta decisión italiana demuestra que la integración ya no es solamente un debate político o cultural en Europa.     DDL Sicurezza 1869, protezione complementare e integrazione: il nuovo paradigma italiano

    Benvenuti a un nuovo episodio del podcast “Integrazione o ReImmigrazione”. Io sono l’avvocato Fabio Loscerbo. Il dibattito parlamentare sul DDL Sicurezza 1869 sta mostrando una trasformazione molto profonda del diritto dell’immigrazione italiano. Il tema centrale non riguarda soltanto il rafforzamento dei controlli, dei rimpatri o delle misure di sicurezza. Sta emergendo progressivamente un nuovo modello fondato sul rapporto tra permanenza dello straniero e livello di integrazione raggiunto nel territorio nazionale. Nel linguaggio parlamentare compare sempre più frequentemente il concetto di protezione complementare. Questo passaggio è molto importante perché segnala uno spostamento del sistema giuridico italiano verso una valutazione sempre più centrata sull’integrazione concreta della persona straniera. Il lavoro stabile, la continuità reddituale, la conoscenza della lingua italiana, la stabilità abitativa, il rispetto delle regole, le relazioni sociali e familiari costruite in Italia stanno diventando elementi sempre più rilevanti nella valutazione della permanenza legittima nel territorio dello Stato. La protezione complementare tende così a diventare il principale strumento giuridico attraverso cui valutare il livello di radicamento dello straniero nella società italiana, soprattutto attraverso il bilanciamento previsto dall’articolo 8 della Convenzione Europea dei Diritti dell’Uomo sul diritto alla vita privata e familiare. In questo contesto emerge il paradigma “Integrazione o ReImmigrazione”. La permanenza stabile non appare più come una conseguenza automatica della semplice presenza fisica nel territorio nazionale. Diventa invece sempre più collegata all’esistenza di un autentico percorso di integrazione nella comunità ospitante. Chi costruisce una reale integrazione rafforza progressivamente la propria posizione giuridica. Chi invece non sviluppa alcun significativo percorso di inserimento rischia progressivamente di collocarsi nell’area del ritorno e dell’allontanamento. Il vero cambiamento in corso nel diritto dell’immigrazione italiano è probabilmente proprio questo: il passaggio da un sistema fondato prevalentemente sul diritto di ingresso a un sistema fondato sempre di più sul diritto all’integrazione effettiva.
