    Today, Tina interviews Dr. Jason De León, a professor at the University of California, Los Angeles, where he holds a split faculty position in the Department of Anthropology and Chicana/o Studies. Dr. De León's research interests revolve around theories of violence, materiality, Latin American migration, photoethnography, forensic science, and archaeology of the contemporary. Protests have erupted in India after the Indian Government announced on Monday that the Citizenship Amendment Act, or CAA, which was passed in 2019 but not not enforced, will now be brought into effect. The CAA will come into force on the eve of elections, and is India’s first religion-based citizenship test, discriminating against Muslims and other refugees. This act has brought about critique from many student groups throughout the country, as well as human rights groups and state government leaders. So, why is this act so controversial? According to Prime Minister Narendra Modi of the Bharatiya Janata party, the goal of the CAA is to help the persecuted. An article from the intercept states, “that he has framed the CAA as a noble effort to welcome Hindus who are oppressed in neighboring Muslim-majority countries.” However, the intricacies of the law make it clear that it will prevent many Muslim refugees from entering India. Before the law was passed, all foreign nationals must spend 11 years in India before gaining citizenship eligibility. Now, the CAA will expedite this process to only 5 years for certain groups fleeing persecution who arrived before December 31, 2014. These groups are Hindus, Buddhists, Jains, Christians, Parsis, and Sikhs seeking asylum from Afghanistan, Pakistan, and Bangladesh. According to Aljazeera, Muslim asylum seekers will still need to wait 11 years, and, unlike other religious groups, will be required to have valid documentation to justify their presence. This means that once they reapply for citizenship through the online portal provided by the government, they will become refugees, and in order to reenter, many will need the proper documentation, which is unlikely that they will have.  Additionally, the passage of the National Register of Citizens, which is designed to deport people without the proper papers, is leaving very few options for Muslim asylum seekers. Although the law is only in effect in the northeast state of Assam, many fear it will become a nationwide policy. With these two policies combined, the country would be able to deport all “illegal” immigrants, and only allow reentry to Hindus, Sikhs, Parsis, Buddhists, Jains, and Christians, according to Aljazeera.  Modi has denied any wrongdoing, but many critics have noted the previous anti-Muslim actions this year, such as the move to strip Kashmire of autonomy back in August of 2023, and a long history of violence and breaches of international law in the six detention centers located in Assam, where majority Muslim asylum seekers are being held, says the Intercept. The Hindu writes that West Bengal Chief Minister says the CAA would take away rights and lead people to detention camps, later stating, “Those who are being asked to apply, the moment they apply, from becoming citizens they will become illegal refugees. What will happen to your properties, your jobs and the studies of your children? Everything will be declared illegal.”  These actions have drawn criticism from all over the country, with hundreds of thousands of protestors, majority being students. However, the intercept noted that some students were protesting against the snti-Muslim policies, while other were protesting the expedited process for any group of immigrants. According to Aljazeer, Many are regarding the actions of the BJP as unconstitutional, citing article 14 of the constitution. The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.     Summary of Recent ICJ Rulings Against Israel | News

    Today, Shireen shares with us the recent court ruling from the case brought to the International Court of Justice by South Africa against Israel. Script: Hello everyone, and welcome back to another episode of Seeking Refuge News. I’m Shireen Kaur, and today we will be discussing the recent court ruling from the International Court of Justice, or the ICJ, regarding the genocidal actions committed by Israel in Palestine. For context, South Africa brought Israel to the ICJ on December 29th, 2023, accusing Israel of intending to commit a genocide against the people of Palestine. In this 84 page document, it was argued that Israel’s action in Gaza intended to destroy “a substantial part of the Palestinian national, racial, and ethnic group.” This is a direct violation of the 1948 Genocide Convention, says foreignpolicy.com. One of South Africa’s lawyers, Tembeka Ngcukaitobi, stated, “The intent to destroy Gaza has been nurtured at the highest level of state.” Within this filing, South Africa lists eight actions against Palestinians in Gaza that are genocidal in nature. (Foreignpolicy.com) (1) Killing Palestinians, including children, in large numbers, (2) Causing serious bodily and mental harm to Palestinians, including children, and inflicting on them conditions of life intended to bring about their destruction as a group, (3) Causing mass displacement and expulsion of Palestinians from their homes, alongside the large-scale destruction of homes and residential areas, (4) Depriving Palestinians of access to adequate food and water, (5) Depriving Palestinians of access to adequate medical care, (6) Depriving Palestinians of access to adequate shelter, clothes, hygiene, and sanitation, (7) Causing destruction of life for the Palestinian people, (8) Imposing measures intended to prevent Palestinian births.    Israeli President Isaac Herzog condemned South Africa’s allegations on Tuesday, calling them “atrocious and preposterous. Israel is expected to argue this on Friday. The Israeli Foreign Ministry has already written, “Israel is at war with Hamas, not with the people of Gaza…it is committed to conducting its operations in accordance with international law … and wishes no harm to Palestinian civilians anywhere.”  On January 26th, however, the ICJ has found it is "plausible" that Israel has committed acts that violate the Genocide Convention and that they must ensure “with immediate effect” that Israeli forces do not commit any of these acts, according to NPR. Additionally, the court voted 15-2 that Israel must take all measures to stop anything in relation to genocide in Gaza, and voted 16-1 that Israel must prevent and punish those involved with inciting genocide against Palestinians in the Gaza strip. (NPR) Another 16-1 vote ensured the provision of “urgently needed humanitarian aid and basic services.” Israel has now received 30 days to report back on the measures that they have been told to move forward taking. Benjamin Netanyahu does not find this ruling appealing, saying, “LIke every country, Israel has an inherent right to defend itself.” He goes on to reject the ruling, “The vile attempt to deny Israel this fundamental right is blatant discrimination against the Jewish state, and it was justly rejected... We will continue to do what is necessary to defend our country and defend our people." Considering this is the second time a state has ever tried to litigate the charge of genocide to another state (the first time against, Myanmar, who promptly ignored the ruling), there are many uncertainties to how this ruling will be enforced, or if it will be at all.  Considering that the United States is Israel’s closest ally, they would likely veto any attempt to impose sanctions at the U.N. Security Council. This, however, could come at the cost of international goodwill and possibly economic sanctions from individual states, according to NBC news. The United States has repeatedly reiterated its stance that the accusations against Israel are unfounded. Washington’s own calls for the minimization of civilian harm and increasing humanitarian assistance are consistent with Friday’s ruling. NBC further states, “The U.S. recognizes that the court plays a vital role in the peaceful settlement of disputes,” and a State Department spokesperson said, “we will continue to monitor this proceeding as it moves forward.” Of course, the U.S. government’s history of support for Israel makes any intervention or “peaceful settlements” unlikely.  Here in the U.S., there are groups combating the governments role in Israel genocide. TIME stated on January 25th that a federal court case has been filed against President Biden and two U.S. cabinet officials for “allegedly being complicit in Israel’s genocide against Gazans.” This was filed by Palestinian human rights groups and the nonprofit Center for Constitutional Rights. TIME said, “Defense for Children International-Palestine v. Biden seeks to stop the U.S. from supporting Israel, which plaintiffs say has cost them the lives of family members, and will be heard in Oakland California.     Escalation of Humanitarian Crisis in Syria | News

    In today's episode, we discuss the rising humanitarian crisis in Syria. Hello everyone, my name is Anusha, and welcome back to Seeking Refuge News. Today, we will be talking about the rising humanitarian crisis in Syria. As international attention centers on the Israel-Gaza crisis, reports indicate an escalation in the bombardment of northwest Syria by Syrian government forces and their Russian allies. Al Jazeera notes on November 14, 2023 that the attacks in October which are concentrated on cities and villages in the countryside of Idlib and Aleppo, have resulted in the deaths of 66 civilians, including 23 children, and the injuries of 270, 79 of whom are children, as reported by a Syrian volunteer emergency rescue group. Opposition leaders and emergency volunteers point out that Russia and the Syrian regime are exploiting the world's distraction to intensify their campaign in northwest Syria. The motive is to exert pressure on Turkey and Syrian opposition factions, regarding issues such as the opening the international road between Syria and Turkey. AP News notes the Syrian government, backed by Russia, intensified its northwest campaign following a drone attack in the government-held Syrian town of Homs, one of Syria’s deadliest attacks in years. David Carden, the U.N. deputy regional humanitarian coordinator for Syria says, “We’re at the most significant escalation of hostilities since 2019. What Syrians want above all is to return home to their homes, but right now they do not feel safe to do so.” Humanitarian agencies and rights organizations have documented strikes hitting hospitals, schools, and other civilian infrastructure, further exacerbating the dire situation in Syria's 13-year conflict, which has so far claimed the lives of over half a million people. The increased violence in northwest Syria has led to a humanitarian crisis, with thousands of individuals being displaced. According to a report from the REACH initiative published on November 14, 2023, 84,093 individuals departed from 58 communities, with 71% returning to their communities during the assessed period of October 3 from October 17. Simultaneously, 55,157 individuals arrived in 135 communities, but only 11,981 returned to their previous communities. The situation has sparked the largest outburst of violence in the Greater Idleb region since 2019, with airstrikes and shelling causing massive numbers of civilian casualties and displacements. Furthermore, according to Al Jazeera on November 15, 2023, in a significant development, France has now issued arrest warrants for Syria's President Bashar al-Assad, his brother, and two other high-ranking officials, following a criminal investigation into the use of banned chemical weapons against civilians in Syria. The warrants are related to chemical attacks in the town of Douma and the district of Eastern Ghouta in August 2013, resulting in the deaths of over 1,000 people.
